1. Introduction
Welcome to Compliance And Risk Management System ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our platform, including our website, API, and services related to risk and compliance management (collectively, the "Service").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Definitions
"M-Pesa" refers to the mobile phone-based money transfer service operated by Safaricom and other telecommunications providers across various African countries.
"Credits" refer to the pre-purchased units required to use our Service for decoding transaction hashes.
"User," "you," and "your" refer to individuals or entities accessing or using our Service.
3. Service Description
Compliance And Risk Management System provides a platform for decoding and verifying Mobile-money transaction hashes. Our Service allows users to:
- Decode individual Mobile-money transaction hashes
- Upload and process multiple transaction hashes in bulk
- Access transaction details through our API
- Generate reports based on processed transactions
Our Service is intended for use by businesses and individuals in countries where M-Pesa is operational, including but not limited to Kenya, Tanzania, Democratic Republic of Congo, Mozambique, Lesotho, Ghana, and Egypt.
4. Account Registration and Eligibility
To access certain features of our Service, you must register for an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years old and legally capable of entering into binding contracts to use our Service. If you are using the Service on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.
We reserve the right to refuse service, terminate accounts, or cancel transactions at our discretion.
5. Credits and Payment Terms
Our Service operates on a pre-paid credit system. Credits must be purchased before using our hash decoding services.
5.1 Credit Purchases
Credits can be purchased through our platform using M-Pesa or other supported payment methods. Credit packages and pricing are as displayed on our website and may be updated from time to time.
5.2 Credit Expiration
Credits do not expire unless explicitly stated at the time of purchase. We reserve the right to implement expiration policies with prior notice to users.
5.3 Refunds
Credits purchased are non-refundable except where required by applicable law. In cases where our Service fails to decode a valid Mobile-money transaction hash, the credit used may be refunded to your account at our discretion.
5.4 Transaction Fees
We do not charge additional fees for processing payments. However, your payment provider (including M-Pesa) may impose transaction fees, which are your responsibility.
6. Mobile Money Transaction Processing
6.1 Processing Times
While we strive to process transaction hash decoding requests promptly, processing times may vary based on system load and other factors. Standard processing times are typically within seconds for individual requests and may take longer for bulk uploads.
6.2 Transaction Limitations
Our Service can only decode transaction hashes from supported M-Pesa operators. We may be unable to decode certain transaction types or hashes from unsupported regions.
6.3 Transaction Data Retention
Decoded transaction data is stored in your account for reference purposes. We retain this data in accordance with our Privacy Policy and applicable regulations.
7. Acceptable Use Policy
You agree not to use our Service for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree not to:
- Use our Service for fraudulent activities or to facilitate illegal transactions
- Attempt to decode transaction hashes without proper authorization
- Use automated methods to access our Service in a manner that exceeds reasonable use parameters
- Reverse engineer or attempt to extract the source code of our Service
- Interfere with or disrupt the integrity or performance of our Service
- Attempt to gain unauthorized access to our Service or related systems
- Use our Service to infringe upon the privacy rights of others
Violation of these restrictions may result in the termination of your account and potential legal action.
8. Compliance with Local Regulations
Our Service is designed to comply with regulations applicable to Mobile-money transactions in supported countries. However, you are responsible for ensuring your use of our Service complies with all local laws and regulations applicable to your business or personal activities.
8.1 Anti-Money Laundering Compliance
You agree to use our Service in compliance with all applicable anti-money laundering (AML) laws and regulations. We reserve the right to report suspicious activities to relevant authorities as required by law.
8.2 Know Your Customer (KYC) Requirements
We may require additional verification information to comply with KYC requirements in certain jurisdictions. You agree to provide such information promptly when requested.
8.3 Tax Compliance
You are solely responsible for determining what, if any, taxes apply to your transactions. We are not responsible for determining whether taxes apply to your transactions or for collecting, reporting, or remitting any taxes arising from any transaction.
9. Intellectual Property Rights
Our Service and its original content, features, and functionality are owned by Compliance And Risk Management System and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not duplicate, copy, or reuse any portion of our Service without express written permission from us.
10. API Usage Terms
If you use our API, you agree to the following additional terms:
- You will not share your API keys with unauthorized third parties
- You will implement reasonable security measures to protect your API keys
- You will not exceed the rate limits established for API calls
- You will properly attribute our Service when displaying data obtained through our API
We reserve the right to modify or revoke API access at any time.
11. Limitation of Liability
To the maximum extent permitted by law, Compliance And Risk Management System shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Errors or inaccuracies in transaction hash decoding
Our total liability for any claim arising from or relating to these Terms or our Service shall not exceed the amount you paid to us during the six (6) month period preceding the claim.
12. Disclaimer of Warranties
Our Service is provided on an "as is" and "as available" basis. Compliance And Risk Management System makes no warranties, expressed or implied, regarding the operation or availability of the Service.
We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.
While we strive for accuracy, we cannot guarantee that all transaction hash decodings will be 100% accurate or complete.
13. Indemnification
You agree to defend, indemnify, and hold harmless Phone Number Hash Decoder and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
14. Dispute Resolution
14.1 Informal Resolution
Before filing a claim against Compliance And Risk Management System, you agree to attempt to resolve the dispute informally by contacting us. We will attempt to resolve the dispute informally by contacting you via email.
14.2 Arbitration
If the dispute cannot be resolved informally, you and Phone Number Hash Decoder agree to resolve any disputes through binding arbitration in accordance with the laws of Kenya, rather than in courts of general jurisdiction.
14.3 Exceptions
The arbitration agreement does not preclude you from bringing issues to the attention of relevant regulatory authorities or from seeking injunctive relief in a court of competent jurisdiction.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
For users accessing our Service from other countries where M-Pesa operates, local laws may also apply to certain aspects of these Terms.
16. Changes to Terms
We reserve the right to modify or replace these Terms at any time. Material changes will be notified to you via email or through our Service. Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.
17. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

19. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
20. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Compliance And Risk Management System.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Compliance And Risk Management System regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements.
